PURPOSE

This procedure establishes guidelines for the payment of accrued leave at the time of separation from employment at Hillsborough College.

PROCEDURE

When an eligible full-time employee leaves the College, the College will compensate full-time employees for frozen accrued sick leave, accrued sick leave, accrued compensatory time earned and accrued vacation leave.

  1. DEFINITIONS

    “Educational support employee” means any person employed by the College in a full-time role as a member of the operations, maintenance or comparable department; or a secretary, clerical or comparable level support employee. Human Resources shall determine if an employee’s position falls into one of these classifications.

    “Instructional staff” shall be used synonymously with the word “teacher” or “faculty” and includes faculty members, librarians, counselors and other comparable members engaged in an instructional capacity in a full-time role at the College. Human Resources shall determine if an employee’s position falls into one of these classifications.

    “Other employee” means any person employed by the College in a full-time role in a position other than an educational support employee or instructional staff.

    “Eligible full-time employee” means an employee that has been employed in one or more full-time positions with the College for a consecutive total of at least six years.

  2. FROZEN OR PREVIOUSLY ACCUMULATED SICK LEAVE

    For any eligible full-time employee, any unused sick leave accumulated before July 1, 2001, shall be made pursuant to the rules, policies or procedures of the District Board of Trustees that were in effect on or prior to June 30, 2001.
     

  3. EMPLOYEES COVERED BY A COLLECTIVE BARGAINING AGREEMENT

    Any eligible full-time employee that is covered by the terms and conditions of a collective bargaining agreement shall be awarded separation pay pursuant to the terms and conditions of their applicable collective bargaining agreement.
     

  4. EDUCATIONAL SUPPORT EMPLOYEES AND INSTRUCTIONAL STAFF

    Eligible full-time employees who are classified as educational support employees or instructional staff shall receive terminal pay of unused accrued sick leave paid to the employee upon separation or retirement, or to the employee’s beneficiary, if the service is terminated by death. Terminal pay will be calculated by multiplying the daily pay rate of the faculty member or educational support employee times the number of days of accumulated unused sick leave times the percentages, as determined below:

    • 6 years: 40% 
    • 7 to 9 years: 45% 
    • 10 years: 50% 
    • 11 to 30 years: 50% plus 2.5% for each year of service over 10 years up to a maximum of 100%

    Terminal pay may not exceed an amount equal to 60 days or 450 hours of the employee’s pay.
     

  5. OTHER EMPLOYEES

    Eligible full-time employees that are other employees shall receive terminal pay of unused accrued sick leave paid to the employee upon separation or retirement, or to the employee’s beneficiary, if the service is terminated by death. Terminal pay will be calculated by multiplying the daily pay rate of the other employee times the number of days of accumulated unused sick leave. Terminal payment may not exceed an amount equal to one-fourth of the employee’s unused sick leave or 60 days, whichever amount is less.
     

  6. ACCRUED COMPENSATORY TIME

    The College will compensate an employee for accrued compensatory time upon his/her separation. Accrued compensatory time will be awarded at the rate of pay effective at separation.
     

  7. ACCRUED VACATION LEAVE

    For an employee with accrued vacation leave, the College will compensate an employee for accrued vacation leave up to thirty (30) days. An employee, upon entering the DROP program, may be paid vacation leave under this section and will not be eligible for further vacation payout upon leaving the College.
     

  8. CALCULATION OF SEPARATION PAY

    For the purpose of calculating separation pay, the daily rate for all administrators and staff employees will be determined by dividing the annual rate of pay by 260 days. For the purpose of calculating separation pay, the daily rate for all faculty will be determined by dividing the annual rate of pay by 160 days.
